Full terms & conditions for My Little Cakery are detailed below.

These Terms and Conditions of Sale set out how you (customer/client/user) can make purchases from My Little Cakery (us/we) c/o Natalie Crooks 30 Londesborough Road, Market Weighton YO43 3HS. 

Our terms are governed by UK legislation.

 

Please read them carefully. 

 

By paying your deposit it will be deemed that the terms and conditions are understood and accepted as applying to your order.

 

DEPOSITS

A non-refundable deposit (price advised) is required in order to secure the commission of your cake and chosen date with My Little Cakery. 

 
Following your consultation / enquiry, your quote is valid for up to 5 Days. Paying your deposit will secure this price & the slot in the diary. 
 

If your deposit is not paid within 5 days of quoting then we reserve the right to cancel any previous arrangements or quotations.

 

PRICES

All prices are non-negotiable and priced according to your design and the size of your cake. Prices do not include VAT.  We may change our quoted prices at any time but changes will not affect any order in respect of which we have already sent you a final order confirmation. 

 

If we are unable to contact you using the details you provided during your order process, we will treat your order as having been cancelled and notify you in writing. We are under no obligation to provide you with a product at an incorrect (lower) price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

 

FINAL BALANCE PAYMENT

 

Final payment for your wedding cake is required no later than 30 days before the collection/ delivery. It is your responsibility to remember to send this payment, as a reminder is not issued. 

 

Final payment for your celebration cake can be made 48 hours in advance of the day of collection. Cheques cannot be used as payment. 

 

If full payment is not received 48 hours before cake collection / delivery then the order will not be released and it is accepted that your order will be cancelled.

 

CANCELLATION

If cancellation of an order takes place, we reserve the right to retain your non-refundable deposit. If cancellation takes place less than 7 days before the event then we reserve the right to seek 100% of the order value. 

 

Cancellation must be made in writing (by letter or email) to My Little Cakery and will only be deemed to take effect from the date your letter/email is received at our premises. 

 

If you postpone the event, we will endeavour to transfer your order providing the date is suitable for ourselves, otherwise it shall be treated as a cancellation (see above). 

 

We retain the right to cancel the booking and retain any deposit paid if full payment is not received 48hours in advance of the collection/ delivery date.

 

We retain the right to cancel the booking in very unusual circumstances beyond our control, such as fire or ill health, during which we will refund any money taken in full less any expenditure e.g. cake tasting boxes/consultation time. Should the unforeseeable occur, My Little Cakery will, where possible, find an alternative cake maker to assist you.

 

ALTERATION & CHANGES

It is your responsibility to read & check the quote thoroughly; any amendments to design should be advised by mail asap. 

If requested, we will try to adjust the design where possible, but sometimes this is not possible according to the nature of the request or amount of notice given. If the alteration affects the cost, or prep for the original design has already been undertaken, then your balance will be adjusted accordingly. Please warn us when you pay your deposit if you are undecided on the design. 

 

We reserve the right to change the design at any point if circumstances beyond our control, may compromise the quality of the finished cake, e.g. Melting due to weather. 

Each cake is made individually by hand, so although every effort is made to ensure consistency, a small amount of variation may occur from the design requested / picture supplied.  

 

ALLERGIES & SPECIAL DIETARY REQUIREMENTS

My Little Cakery cannot guarantee that our products are free from ingredients that may affect those with food allergies. My Little Cakery recognises the seriousness of food allergies and would recommend that you

discuss with us if you or any of your guests have special dietary requirements. A full list of allergens per product is available on request. Please note that some food colourings may have an adverse effect on behaviour in children.

 

NON-EDIBLE ITEMS

Most cakes will contain small parts of inedible items; it is the client’s responsibility to ensure these are removed by your caterer/guests before consumption e.g. Support dowels in tiered cakes, ribbon, wires in sugar flowers, flower picks & flower tape etc. My Little Cakery does not accept responsibility for any physical harm that may occur from the use of non-edible decorations.

 

COLLECTION

The correct transportation guidelines will be given to you verbally upon collection. My Little Cakery will not be liable for any damages that occur should these guidelines not be followed. It is recommended that your securely boxed cake is placed in your footwell or boot, ideally on a non-slip mat. My Little Cakery does not recommend that you travel with your cake on a car seat. My Little Cakery cannot take responsibility for damage that occurs to cakes that are collected and transported by the customer. 

 

DELIVERY & SET UP

It is your responsibility to provide a stable and level surface avoiding highly trafficked areas such as services area for catering staff etc for your cake setup. My Little Cakery reserves the right to change the design/ set up at any point if circumstances beyond our control, may compromise the stability of the cake, e.g. uneven surface requires cake stand to be removed/ changed. Once the cake has been delivered and set up, the care and condition of the cake becomes your responsibility. My Little Cakery is not liable for any damage that may occur thereafter, including damage, accidental or otherwise, to the cake, cake stand, cake table or where extreme weather conditions cause the cake to deteriorate or any other possible cause.

 

CAKE TASTING BOXES

Our cake tasting boxes are usually sent out on a Thursday via the Royal Mail 24 Hour Tracked service and should reach you within a 48hour period after dispatch is confirmed. We will provide you with a tracking number for your package. We aim to deliver your sample box within an agreed period of time however we are not responsible for delays which may occur to your order and we will take steps to minimise the effect of the delay. If you provide us with instructions relating to your delivery, it is your responsibility to ensure the accuracy of these instructions and we shall not be liable for any loss or damage resulting from our following of your instructions. You are responsible for ensuring that the delivery is accepted at the address provided in accordance with your instructions.

Please make it clear to us at the time of booking if there are any particular dates where you will not be able to accept a delivery. We will do our best to accommodate you and despatch your order at a more suitable time. 

 

STORAGE

All cakes should be stored at room temperature (ideally no more than 21 degrees Celsius), out of direct sunlight and on a flat surface. No preservatives or additives are used in My Little Cakery products therefore they should be consumed within 72 hours of the delivery/collection date.

 

LOCATION/ OUTDOOR WEDDINGS

Humidity and heat can have an adverse effect on your cake. In warmer months, it is recommended that you cake is stored/displayed in a cool area, ideally air conditioned. It is recommended that the location of your cake is considered that it is not displayed in direct sunlight or in an area where the sunlight will eventually move to. My Little Cakery cannot be responsible for any damage that may occur due to weather conditions or outdoor locations including heat, humidity or insects. It is recommended that a 'back-up' plan is agreed in case of inclement weather. This may included preparing an alternative location to display the cake, arranging an alternative time for delivery and set up or bringing forward cake cutting time.

 

TERMS OF BUSINESS - FAULTY GOODS

My Little Cakery shall not be liable for any consequential loss to the customer whether this arises from a breach of contract or any other way. My Little Cakery's total liability for any claim howsoever arising will not exceed the price of the good supplied by My Little Cakery to the customer. We only supply products for domestic and private use and you agree that our products will not be used for commercial, business of re-sale purposes. We have no liability to you for any loss of profit, loss of business, business interruption of loss of business opportunity.

If you are unsatisfied with your product, or mis-described immediately notify us within 24hours of collection/delivery to nat@mylittlecakery.com with a detailed description of the fault and, if possible, photographs of any issues with the product.

You will need to return your product (minimum of 95% of the original product) to us within 48hours from collection/delivery to: My Little Cakery, 30 Londesborough Road, Market Weighton YO43 3HS.

Returned products are examined and confirmation will be provided if you are entitled to a refund. If you are entitled to a refund, you will receive a full refund of the price paid for the product. My Little Cakery will try its utmost to replace said product if the time frame permits.

 

These terms and any claim or dispute arising in relation to any purchase will be governed by English Law. You agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any such claim or dispute. 

 

 

PRIVACY POLICY

 

PHOTOGRAPHY

My Little Cakery reserves the right to use their photographs of your cake(s) for advertising and promotional purposes. 

 

GDPR Policy
As of the 25th May all businesses have to be GDPR compliant.

My Little Cakery will only hold the minimum of personal data required to fulfil your order (for example your name, telephone number, address, email address.) My Little Cakery does not store any card or bank details. My Little Cakery will ask for the contact details at the time of ordering via phone, email or social media in order to process your order. Any messages prior to the 25th May 2018 will be destroyed (Unless a current customer).

My Little Cakery does not run any digital marketing campaigns and will not pass any of your details to third parties unless instructed to do so by you to facilitate the delivery of your order. Your data is held solely to facilitate your order, once your order has been fulfilled your data will be held for the necessary time and then securely destroyed. You have the right to ask at any time about your data and its use. Please email us at nat@mylittlecakery.com if you have any concerns.

All personal information held by My Little Cakery is stored on a PC or a phone that is password and code protected. These passwords are updated regularly and the devices have the relevant up to date security software.
Any printed data held is kept in a locked cabinet inside a locked room. Once your order has been fulfilled the data is shredded and destroyed.
